The court accepted PW1's direct evidence, international law principles on river centre lines and the State Council Gazette to find the appellant had crossed the Shenzhen River onto Hong Kong soil; the appellant's intention to enter Hong Kong illegally satisfied the mens rea for s.38(1)(b); and the closed area was accessible to a section of the public under Gazette permission and therefore constituted a public place, so convictions for all three offences were sustained.
