The appellate court upheld the sentencing judge's finding that the s45 Mental Health Ordinance requirements were satisfied on the basis of two psychiatric reports and that a 3-month hospital order was appropriate and not excessive; questions about post-order transfer are matters for the hospital and not for the court.

A hospital order that specifies only a minimum term without a clear release date is inconsistent with the Mental Health Ordinance (notably s50 and s36(4)) because it creates uncertainty about when statutory procedures begin; therefore the original minimum-term-only order was set aside and substituted with a specified 12-month hospital order under s45 as the appropriate and clear disposition in the circumstances.

The appeal was dismissed because the Magistrate properly relied on two independent psychiatric reports diagnosing schizophrenia, establishing need for inpatient treatment and risk factors; the Magistrate considered mitigation and reduced the recommended four-month inpatient recommendation to a two-month Hospital Order to account for time already spent in hospital, and there was no justification to interfere with that exercise of discretion.
