Although the magistrate should have indicated rejection of the appellant's mitigation, the individual sentences (4 months for breach of deportation order and 18 months for remaining without authority) were appropriate and justifiably ordered to run consecutively; on appeal the court allowed reduction by act of mercy by ordering the sentences to run concurrently, resulting in an 18‑month total sentence.
