Although custodial sentences are appropriate in principle for sexual activity with young persons, the appellate court found the original three month term excessive on the facts (no persuasion, prior relationship or corruption, appellant's mitigation and apparent mistake as to age) and reduced the punishment to time already served plus a nominal fine of $2,000.
