The Company discharged the onus of establishing a bona fide dispute on substantial grounds by credible documentary and testimonial evidence (audited accounts showing nil turnover, bank statements showing payments from TSBVI, purchase order practice and staff transfer records) raising real doubt as to whether the Company, rather than its BVI parent, contracted for the goods; accordingly the petition was dismissed and costs were awarded to the Company.
