On the balance of probabilities the court found Lam was instrumental in planning, establishing and operating a competing sonic tube business (Agility) during his employment, he used and disseminated Dextra/DBPG confidential information and technical materials, and attempted to destroy evidence; those acts breached duties of fidelity and confidence and justified summary dismissal. Dextra/DBPG proved loss of profit for a nine‑month loss period and was awarded RMB4,135,569 plus pre‑judgment interest RMB1,323,382; delivery up, injunction and costs were ordered.
