Section 10(5) deems permanence after the prescribed period and thus s.9 applies; the respondent failed to prove on evidence that the applicant's incapacity was inevitably due to pre-existing avascular necrosis rather than the accident which aggravated and accelerated the condition; accordingly the Court affirmed the judge's finding that the accident caused the incapacity and upheld the 90% loss of earning capacity award.
