Although the magistrate was entitled to impose a custodial sentence for driving in defiance of a disqualification order and that sentence was not wrong in principle or manifestly excessive, the appellate court allowed the appeal in part and suspended the one month imprisonment for 18 months because of significant mitigating material (medical condition and loss of employment) presented on appeal.
