The jury were properly directed that the central issue was knowledge and that inconsistencies about the appellant's finances were one of many circumstantial matters; a full lies direction was not required and the conviction was safe. Sentencing required allowance for exceptional mitigation (grooming, vulnerability and substantial cooperation in a prolonged controlled delivery) resulting in reduction of the notional starting point to produce a final term of 22 years' imprisonment.

The trial judge erred by applying post-Tam Yi Chun/Abdallah tariffs to an offence committed before that decision; applying pre-Tam practice and relevant comparators yields a starting point of 22.5 years, enhanced to 24.5 years for the international element, and after allowing a 40% total discount for guilty plea and substantial cooperation (participation in a controlled delivery) the appropriate sentence is 14 years 8 months' imprisonment, therefore the original sentence is quashed and substituted accordingly.

The Court concluded the original sentence was within appropriate range for the quantity of drugs, but the applicant was entitled to limited credit for cooperation; accordingly the sentence was reduced from 6.5 years to 5.5 years imprisonment. Personal hardship and disparity with a co-offender did not justify further reduction.

The Court reduced the sentence from six to four years because the judge had overstated the applicant's role and benefit in the forging operation; the applicant was not a chief conspirator, received modest nightly payments, and did not receive the major part of the profit, so a four year sentence was appropriate.

The court held that because Li had been dealt with leniently for cooperation, the 12-month sentences on the second, third and fourth appellants were disproportionately high compared with Li's role as prime mover and thus quashed and substituted with concurrent six-month terms plus confirmed fines; the first appellant's 15-month sentence was justified and affirmed due to his supervisory position and greater culpability.
