The application for leave to appeal was refused because the proposed appeal had no reasonable prospect of success: the loan agreement had been terminated before the defendant requested a settlement statement so s19(1) did not apply; the indebtedness and amounts were sufficiently disclosed in the plaintiff's pleadings and affidavits; the defendant's contrary contention was implausible and undermined by his own payment of $19,000; accordingly there were no other reasons warranting permission to appeal.
