Judge found on the balance of probabilities that the 2019 Loan Agreements existed, that copies of the 2016 and 2019 agreements were provided and that the defendant was an experienced businessperson who received loans and legal advice; consequently the trial court would likely exercise its discretion under ss 18(3) and 22(3) MLO to hold the agreements enforceable for principal sums. Therefore plaintiff would obtain judgment for the principal and interim payment was appropriate; appeal dismissed and interim payment ordered by specified date with costs.
