The court refused to grant the declaratory relief without a trial and dismissed the amended originating summons because the plaintiff failed to demonstrate necessity for a declaration in the absence of full adjudication, the declarations could adversely affect third-party rights (the mortgagee SCB), the SCB proceedings are the proper and better forum to resolve competing interests, and there was no compelling reason to depart from the normal practice of refusing declarations without trial.
