The appeal is allowed in part: payments by the insurer under the MIB scheme did not extinguish the plaintiffs' entitlement to pre-judgment interest under s.48 for the January–December 2002 period; Ming An is entitled to complete the assessments by including pre-judgment interest for PSLA and special damages for that period but not interest on general damages awarded for future losses; the appropriate additions are HKD 97,187 for Ms Chan and HKD 6,959 for Ms Tse.
