The 2nd defendant failed to show it was plain and obvious that multiple derivative actions are impermissible under BVI common law or that, as a matter of substantive BVI law, prior permission of the BVI High Court is a necessary precondition for the plaintiff to bring a multiple derivative action in respect of HK Wise Park; accordingly the strike out application must be dismissed.
