The Guardianship Board’s findings and decision were unsafe because no qualified Mandarin-Cantonese interpreter was provided and the Board failed to ascertain the subject’s language needs; the Board’s reliance on the subject’s apparent lack of response at hearing was tainted by that procedural unfairness. The guardianship order was therefore quashed, and because the applicant demonstrated a comprehensive care plan and the respondent did not require a fresh application, the court set aside the order rather than remit for rehearing.
