On the facts the appellant established on the balance of probabilities that the demand notice did not come to his personal notice without neglect because the mail mix-ups were occasional, he took reasonable steps to address them and it was not reasonable to require alternative arrangements; accordingly the magistrate's finding of neglect was wrong and the order for additional penalty and costs was rescinded.
