The Court held that the 1st defendant was not entitled to succeed: (a) a person who has succeeded to his natal male line and its property cannot validly cross over to succeed another male line without contravening the concept of family property and accepted Qing adjudicatory practice; and (b) posthumous adoption necessary to effect such succession has been abolished by the Adoption Ordinance s25, so there is no person who can succeed the deceased under Article 88(2) and therefore the daughters inherit the property.
