The judge correctly applied sentencing methodology: identified statutory/normative starting points for the narcotic quantities, applied the combined approach using methamphetamine as the base drug, added a modest uplift for trafficking in two types of drugs, reduced the guilty plea discount because the applicant's mitigation was rejected after a Newton inquiry, and lawfully ordered part of the divan sentence to run consecutively while applying the totality principle; on that basis the overall sentence of 67 months was not manifestly excessive and leave to appeal was refused.

Trial judge failed to address the defence claim that part of the trafficking quantity was for personal use and did not consider whether a Newton inquiry was required; re-sentencing was necessary. On re-sentencing appropriate starting points were 27 months for trafficking (reduced to 18 months after one-third guilty plea discount) and 18 months each for the two possession counts (reduced to 12 months each after one-third discount). Orders: counts 1 and 2 to run concurrently; count 3 to have one month consecutive, producing an aggregate sentence of 19 months' imprisonment.

The Court held that although the offence was very serious and involved an imitation firearm, the 18-year starting point was manifestly excessive in the circumstances; a 15-year starting point was appropriate, and applying a 25% discount for the guilty plea (reduced because of an adverse Newton inquiry) produced a sentence of 11 years and 3 months imprisonment, which the Court substituted for the original sentence.

Where the total quantity of methamphetamine (1.41 grams) was small and the appellant admitted social distribution to friends, a Newton inquiry was unnecessary; the magistrate reasonably adopted a reduced starting point, applied a one third discount for plea and clear record, and the resultant sentence of 18 months imprisonment was not manifestly excessive, so the appeal was dismissed.

The judge's finding that the robbery was carefully planned and that the accused knew a firearm would be used was inevitable on the evidence (weapons in the getaway car, admissions, planning and conduct); therefore D1's sentence was appropriate and his appeal dismissed. D3's counsel misrepresented instructions to the court; because D3 would have received a greater discount but for counsel's conduct, D3's sentence was reduced to 10 years.

Because the Applicant had agreed the Summary of Facts that the vessel was unseaworthy and the passenger was heavily pregnant, the Judge correctly adopted a six year starting point to reflect those aggravating features and, after applying a guilty plea discount, the resultant four year sentence was not manifestly excessive; the absence of a Newton inquiry on the payment finding was immaterial as that finding was not used to increase the starting point.

The court held the magistrate did not err in law in his approach, rejected the appellant's contention that no contract arose and that a Newton inquiry was required, but concluded the case was less serious (workers were relatives and employment period was short) so the proper starting point was 12 months; after the one‑third guilty plea reduction the appropriate concurrent sentence is 8 months imprisonment, and the appeal is allowed to that extent.
