The High Court held that the magistrate failed to properly inform the unrepresented appellant of his right to make a no‑case submission before ruling that a prima facie case existed; that omission created a real danger to the safety of the conviction because the magistrate's conduct gave an impression that the prosecution evidence had already been accepted, and therefore the conviction was unsafe and had to be quashed.
