On the uncontradicted evidence the respondent breached statutory duties (accounting offences, failure to submit statement of affairs, MPF non-payment and failure to keep informed), establishing unfitness under s168H; in exercise of the court's discretion and having applied the Fifteenth Schedule and relevant authority the respondent is disqualified from acting as a director for two years and nine months beginning on the 21st day after the order, and ordered to pay costs.
