Amendment to re‑characterise the claim from accident to occupational disease was allowed because the defect in the original notice was occasioned by a reasonable mistake and delay caused by obtaining medical and legal advice; the proviso to s14(1) and the court's discretion under s14(4) permit curing the defect where no prejudice to the employer is shown and the applicant acted reasonably.
