The form of the Legislative Council oath is fixed by statute (Oaths and Declarations Ordinance s.16 and Schedule 2) and must be taken 'in accordance with law' under Basic Law Article 104; the applicant's proposed additions alter the form and substance of the oath, are unlawful and of no effect, the Clerk has no jurisdiction to administer them, and the applicant failed to show a prima facie arguable case warranting leave or mandamus.
