Leave to appeal was refused because the plaintiffs failed to raise questions of great general or public importance that were reasonably arguable; the primary findings that the covered playground had been unlawfully converted into enclosed domestic units contrary to the occupation permit and DMC were dispositive and justified applying a lower standard of care to the IO; the novel reliance on clause 25(iii) was impermissibly raised late and lacked merit; accordingly no arguable legal point warranted submission to the Court of Final Appeal.
