Although the trial judge made a misdirection by describing a witness's adopted prior statement as 'not evidence', and other issues were arguable, those matters were not material in the context of the total and narrow evidence; the summing up fairly presented the issues (including expert evidence) and the convictions on counts 1 and 3 were therefore safe; leave was granted but the appeal was dismissed.
