The magistrate's 12-month starting point for this low-value, simple theft was excessive; a nine-month starting point properly accounts for the aggravating factor of prior like offences and, applying the one-third reduction for a guilty plea, a six-month sentence is appropriate. Sentences for offending committed while on bail should be served wholly consecutively to the sentence for the original offence; accordingly the eight-month sentence imposed is reduced to six months and ordered to run consecutively to the existing four-month sentence, maintaining a totality of ten months.
