The appellate court, on rehearing, accepted the magistrate’s assessment that PW1 was credible and reliable given lane closure and slow traffic making observation at distance feasible, found the fresh evidence inadmissible or not materially probative, held there was no legal requirement to prove acquaintance or motive, and concluded the prosecution proved the offence beyond reasonable doubt; therefore the conviction stands.
