On the evidence the judge found that a common intention existed that the deceased had an interest in the Property, supported by the joint mortgage account, the existence of a will bequeathing the Property to the deceased, the defendant's cessation of contributions after moving out and admissions; those facts established a common-intention constructive trust entitling the deceased's estate to 100% of the beneficial interest and required transfer of legal title to the administratrix; defendant's counterclaim for possession failed.
