The court held the chartered surveyor's report was not a valuation of open market value as required by the Tomlin order because it failed properly to address redevelopment/hope value and presented an inadequate methodology; the judge was therefore entitled to reject the report and order a new independent valuation to be conducted by an agreed valuer or, failing agreement, appointed by the president of the HKIAC.
