HKSAR v. NG KA KIT AND OTHERS

    Citation
HKSAR v. NG KA KIT AND OTHERS
    Court
    Court of First Instance
    Case number
    HCMA112/2008

The appellate court upheld the magistrate's acceptance of the police officers' lay estimates of speed and distances as sufficiently reliable for conviction; the magistrate had regard to the s37(7) factors from the evidence and photographic material so specific recital was unnecessary; convictions for dangerous driving were safe and sentences for the 2nd–4th appellants were appropriate, but the 1st appellant's heavier disqualification and fine were reduced because the prior conviction underpinning the harsher sentence had been quashed.
