The summons by the 5th Defendant to vary the costs order nisi was dismissed because the 5th Defendant was not one of the summonsed defendants, the Plaintiff's declaratory relief claim failed irrespective of the 5th Defendant's position, and the 5th Defendant's opposition included multiple grounds beyond prejudice; accordingly it was not appropriate to order the Plaintiff to pay the 5th Defendant's costs, and instead a costs order nisi was made that the 5th Defendant pay the Plaintiff's costs of the Summons, summarily assessed at $20,000.
