The court exercised its discretion under s52A and Order 62 r6 and held that because the litigation was mainly caused by the deceased's unconventional execution of the document (diary entry without witnesses) and it was not unreasonable for the 1st and 3rd defendants to oppose, plaintiff's costs should be paid out of the estate and the 1st and 3rd defendants' own costs should be taxed in accordance with Legal Aid Regulations.
