The Court held that the High Court retains inherent jurisdiction to issue a letter of request in aid of judicial review proceedings related to a criminal cause or matter and that Order 39 is available by virtue of the exception in Order 1 Rule 2(3); the MLAO and s.77E of the Evidence Ordinance do not expressly or by necessary implication oust that inherent jurisdiction; whether to exercise the discretion to grant the letter remains for the trial judge.
