Leave to appeal was refused because the proposed grounds did not raise a reasonable prospect of success: the jurisdictional challenge under Order 11/Order 12 r.8 was not properly live or pleaded; the judge had applied the forum non conveniens test in a manner favourable to the plaintiffs; key findings (lack of urgency or secrecy, material non-disclosure, no risk of dissipation, and that the central factual dispute turns on oral evidence best heard in Russia) were unchallenged and constituted a sound exercise of discretion; accordingly no stay pending appeal was warranted.
