Plaintiffs failed to make it sufficiently to appear that the defendant was under a contractual obligation to pay in Hong Kong; evidence was indirect, scanty and showed past payments mainly to New York accounts and lack of proven business presence in Hong Kong; accordingly the court had no jurisdiction under Order 11 and the application to set aside leave succeeded in part.
