Because the plaintiffs pleaded serious allegations of conspiracy, fraud and false declarations, the matter was unsuitable for summary disposal under Order 14; there was insufficient evidence to treat the Small House Policy as a public policy ground to annul the Agreement at summary stage; issues of illegality, ultra vires and public policy require trial evidence, therefore defendants were given unconditional leave to defend and the striking out application was not pursued.
