Failure to plead service of the notice of termination under s.122(c) was not a fatal defect for the Order 14 application because the requirement is a condition precedent that may be implied in the pleading under Order 18 r.7(4) (following Gates v. Jacobs); consequently summary judgment was appropriate to enter judgment for forfeiture of the rental deposit, subject to the concession that recovery cannot exceed the deposit.
