The second conditional payment notice dated 4 Sep 2013 was validly served on the plaintiff via his then solicitors who remained on record; applying Order 22(23) the court exercised its discretion and limited the plaintiff's recoverable costs to 2 Oct 2013 and ordered the plaintiff to pay the defendants' costs from 3 Oct 2013, with defendants' costs to be assessed on a compensatory/indemnity basis and interest on those costs to be determined pending affidavit evidence of payments to solicitors.
