Order 22 r 23 mandates that where a plaintiff fails to obtain a judgment better than a sanctioned payment the court shall impose the consequences in r 23(2)–(4) unless it would be unjust to do so; the Applicant did not establish injustice or defective service, so the court varied the Costs Order Nisi to impose indemnity costs from the dates the sanctioned payments could have been accepted, directed taxation together before the same Master, ordered sanctioned sums to be paid out as applied for and awarded interest on costs as specified.
