The Offer could not be treated as a sanctioned offer because the Defendant did not comply with Order 22 r 3(2); the Offer could nevertheless be considered as a Calderbank-type offer; the Plaintiff failed to beat the Offer on a net monetary basis but the lateness and form of the Offer, together with the nature of the disputes, meant indemnity costs were not justified and only limited costs relating to the last day of trial should be awarded plus costs of the application.
