Applicant failed to establish on the evidence that the bulk of the documents sought were in the possession, custody or power of the respondents or that production was necessary for the fair disposal of the liability issues given the Split Trial Order; many requests were irrelevant to liability, disproportionate or amounted to fishing; the court will not go behind the respondents' discovery affidavits or decide contested factual disputes at interlocutory stage.
