Because the Requested Documents were expressly referred to in the plaintiff's witness statements and were prima facie producible under Order 24 r.10, and because the plaintiff failed to give a timely and adequate response or to obtain the documents from the witnesses before the summons was issued, it was reasonable for the 4th defendant to issue the Summons and to obtain the documents by other means; the withdrawal did not signify defeat; therefore it is just to order the plaintiff to bear the 4th defendant's costs of the Summons, to be summarily assessed and paid as ordered.
