Leave to appeal was refused because To J did not misapply the law: solvency was properly relevant to the winding up petition, Order 24 and Practice Direction 3.4 permitted the discovery sought, and the Judge correctly concluded that disclosure of the 2009 audited accounts was necessary for fair disposal; accordingly there was no reasonable prospect of success on appeal.
