The court held the defendants’ alleged unauthorised withdrawals were not credible on the evidence and that the undue influence defence did not avail because the transactions were not to the manifest disadvantage of the mortgagors and the bank was not put on inquiry; therefore defendants had no real or bona fide defence and judgment was entered for the bank for the sums claimed and for delivery up of vacant possession of the mortgaged properties.
