Leave granted in limited terms: the defendant may adduce accounting expert evidence restricted to whether the accounts on pages 282–283 constitute audited consolidated accounts showing the NPAT of the AMVIG Group as defined in the Deed. Broader technical questions (Q3–Q5) are irrelevant and will not be allowed. The court directed a timetable for exchange of expert reports and awarded costs to the defendant of 40% of assessed $150,000 (i.e. $60,000) payable by the plaintiff within 14 days with remaining $90,000 in the cause.
