Because the defendant-applicant failed to attend and the plaintiff asked for dismissal, the court refused leave to appeal and dismissed the application with costs to the plaintiff.

The Court upheld the trial judge's exercise of discretion on costs and refused to disturb the costs order because the 2nd Defendant elected to contest the claim on grounds that led to the contested trial; the substantive issue of whether the licence conferred proprietary rights could properly be determined as a matter of law without reliance on the contested factual findings, and therefore the appellant was not entitled to have the full costs of the trial reduced.

Section 21D of the Supreme Court Ordinance excludes shares in private companies from sale in execution and is expressed in general terms applying to all modes of execution; the District Court's ancillary jurisdiction under section 48 is subject to that limitation; therefore the District Court had no jurisdiction to order sale of the Defendant's private company share and the order for sale was rescinded and the summons dismissed.
