The appeal is dismissed and the statement of claim struck out because the plaintiff advanced a position in the present action that is directly inconsistent with sworn pleadings and affirmations he made in HCA 1015/2018, he failed to provide any satisfactory explanation for the inconsistency, and his proffered new evidence was inadmissible as it could have been produced earlier; consequently the pursuit of the claim constitutes an abuse of the court's process, and the master's costs assessment is upheld.
