The court held that appeals from the master in respect of summary determinations (including Order 14 summary judgment) fall within the exception in Order 59 r.21 such that leave to appeal to the Court of Appeal is not required and this court therefore had no jurisdiction to grant leave; accordingly the defendant's application for leave was refused and costs were awarded to the plaintiff to be summarily assessed (not on an indemnity basis).
