Leave to appeal was granted only as to the limited issue of disclosure of that part of Karen Loh's witness statement in HCA 2611/2008 relating to the plaintiff's prior knowledge because that part was reasonably arguable as relevant and raised reasonably arguable questions of litigation privilege and waiver; leave was refused in all other respects because the judge acted within discretion in finding the wider classes were irrelevant, largely privileged or of negligible probative value, and the application could be decided on written submissions under Order 59 rule 2A.
