Rogers VP was plainly right to refuse leave to appeal because the defendants were served by registered post and the decision was delivered on 9 March 2010 making the 22 March application out of time; moreover the substantive leave application was devoid of merit, justifying refusal and the exercise of power under O.59 r.2A(8) to prevent reconsideration.

The application for leave to appeal was an abuse of process because it re-run prior refused applications and was made without disclosure of earlier proceedings; accordingly leave was refused and an order under O.59 r.2A(8) was made preventing further application under para.7; the recusal request was dismissed as unfounded.

The court refused the stay and refused leave to appeal because the appeal had no reasonable prospect of success; late filing of the defendant's skeleton did not alter the absence of reasonable prospects and procedural accommodation for counsel did not justify delaying the application; costs awarded to plaintiffs.
