Because the taxation was part-heard and the preliminary issues were decided within ongoing taxation proceedings, allowing an immediate appeal under Order 58 would be inappropriate; the taxation must continue to completion and any challenge must be pursued under Order 62 procedures after completion. Therefore the plaintiff is not entitled to appeal the preliminary issues before completion of taxation.
